Prohibition Notice - What Do I Do Next?

Now that a Prohibition or Restriction Notice has been served you MUST NOT ignore the conditions of the Notice or you may be liable to prosecution.

This short guide is designed to assist you in what your actions should be once you have decided what you are going to do with the property following the serving of a Prohibition or Restriction Notice.

What are my Options?

If you decide not to appeal the Notice, you have two options.

  1. If you decide to vacate the premises, undertake no remedial works and choose not to use them anymore, please inform the Nottinghamshire Fire and Rescue Service’s Fire Protection Department. The Notice will still remain in force and as such the Prohibition and/or Restriction MUST still be adhered to. The Notice will still be applicable if and when the premises become re-occupied and the conditions remain the same.
  2. If you decide to undertake the Schedule of Steps to reduce the level of immediate risk to life, then once completed you MUST inform the Nottinghamshire Fire and Rescue Service’s Fire Protection Department prior to re-occupation.

Please be aware that the Fire Authority will need to authorise re-occupation which may take up to 24 hours to complete (this could take longer during weekends/Bank Holiday periods).

Other Points to Note

  • Your attention is drawn to the Guidance Notes on the back of the Prohibition Notice / Restriction Notice.
  • The work required (Schedule of Steps) to reduce the level of risk in the premises and allow re-occupation, is the minimum requirement. Other work may still be needed to ensure full compliance with the Regulatory Reform (Fire Safety) Order 2005.
  • As the responsible person for the premises it is your duty to ensure on going compliance at all times with the Regulatory Reform (Fire Safety) Order 2005.
  • Your are advised to contact other relevant authorities to ensure that your premises are suitable for your intended use prior to occupation.
  • Once the Notice has been served the Fire Service will conduct re-visits (without prior notice being given) to the premises as appropriate to check for compliance.
