    Answer: - Current fleet is 129 vehicles

    Answer: - Please be advised Nottinghamshire Fire and Rescue Service has assessed that to disclose some of the requested information in this case by virtue of section 40(2) Personal Information of the Freedom of Information Act 2000. This is due to the vehicles being assigned to singular individuals to perform their duty for the service.

    Answer: - We’ve provided information for the past 3 financial years.

    Answer: - A list of all stations with chargers for electric vehicles all 7kW chargers, beadvised we do not own any charging stations at our joint headquarters with Nottinghamshire Police.

Section 12 – Request where the cost of compliance exceeds the appropriate limit.

Question 5 is not recorded in an easily retrievable format. To locate, retrieve and extract the requested information requires a manual search of all records held, we would have to manually examine each entry to calculate the average mileage per vehicle. This is because the tool to extract the necessary data does not produce average mileage, we would need to scrutinise each mileage entry per vehicle including both current at past vehicles that were active for the duration requested. In addition, the tool does not provide wholly accurate data and contains errors such as duplicates and blank entries that would also need to be manually filtered out.

An initial search revealed a total of 6000 entries over a 6-month period with a further estimated 28,000 entries for the remaining time period.

It is estimated that to search one record would take approximately 10 to 15 seconds which would equate to approximately 89 working hours (for 3 years’ worth of records).

This takes the request over the cost threshold of 18 working hours for a 3-year period and engages Section 12 (1) of the Act. This letter constitutes a refusal notice under Section 17(5) of the Freedom of Information Act 2000 with Section 12(1) of the act being applied.

12.– (1) Section 1(1) does not oblige a public authority to comply with a request for informationif the authority estimates that the cost of complying with the request would exceed theappropriate limit.

Should you wish for the Force to continue with your request, a more accurate figure will be provided within a fee’s notice. The cost will need to be paid by you, prior to any further investigation. Please advise if you wish to proceed.

Alternatively, you are invited to refine your request to bring it within the cost threshold, due to how the information is stored we could only offer the data for the first 6 months. However, this would include vehicles no longer in service with Nottinghamshire Fire and Rescue.

In accordance with the Act, once one part of the request exceeds the cost threshold the entire request exceeds the cost threshold. However, in the spirit of the Act but outside of Nottinghamshire Fire and Rescue Services has provided what information it has retrieved in relation to your request.

This letter constitutes a refusal notice under Section 17 (5) of the Freedom of Information Act 2000.

Section 40: - Personal Information

1. Any information to which a request for information relates is also exemptinformation if—

  1. it constitutes personal data which does not fall within subsection (1), and
  2. the first, second or third condition below is satisfied.

(3A) The first condition is that the disclosure of the information to a member of the public otherwise than under this Act—

  1. would contravene any of the data protection principles, or
  2. would do so if the exemptions in section 24(1) of the Data ProtectionAct 2018 (manual unstructured data held by public authorities) weredisregarded.

(3B) The second condition is that the disclosure of the information to a member of the public otherwise than under this Act would contravene Article 21 of the GDPR (general processing: right to object to processing).

(4A) The third condition is that—

  1. on a request under Article 15(1) of the GDPR (general processing: right of access by the data subject) for access to personal data, the information would be withheld in reliance on provision made by orunder section 15, 16 or 26 of, or Schedule 2, 3 or 4 to, the Data Protection Act 2018, or
  2. on a request under section 45(1)(b) of that Act (law enforcement processing: right of access by the data subject), the information would be withheld in reliance on subsection (4) of that section.

Section 40 of the Freedom of Information Act 2000 is categorised as an Absolute and Class Based type exemption and therefore does not require a public interest test to be carried nor must Nottinghamshire Fire and Rescue Service articulate the harm in disclosure.
